Terms and conditions

Dean or Dean Radar means the sole proprietorship Dean Radar, established in Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce under number 83770089 and with VAT number NL003868118B20. Dean can be contacted at help@heydean.nl.

User means a person using Dean. Consumer means a natural person acting outside that person's trade, business or profession. Service means Dean's digital service, including the account, search profiles, matching and alerts. Match means a listing that the software considers potentially suitable for a search profile.

These terms apply to every use of the Service and every agreement between Dean and the User. A deviation applies only if Dean has confirmed it in writing in advance. Mandatory consumer law always prevails.

The agreement for a free account is formed when Dean accepts the account request and makes access to the Service available. The agreement for a paid subscription is formed when you confirm the order in Stripe Checkout, the confirmation required by Stripe is complete and Dean makes access available. Dean may refuse an application or correct a technical or payment error before access is granted.

Before you place a paid order, we show the main characteristics of the plan, the price, payment frequency, cancellation method and the characteristics of the first subscription period. That information is provided in line with Dutch pre-contractual information requirements for distance contracts, including Article 6:230m of the Dutch Civil Code. The terms are available electronically and can be saved. Dutch is the language of the agreement for the Dutch route and English for the English route; if translations differ in meaning, the Dutch version prevails to the extent mandatory law allows.

Dean checks available external rental listings, organises data and compares it with a search profile. The Service helps you see relevant listings sooner. Dean is not a landlord, letting agent, broker, property adviser, legal adviser or representative of a provider.

A match is not a housing offer by Dean, reservation, viewing, acceptance, allocation, advice to rent or guarantee that a listing is still available, correct, complete or suitable. The external provider decides the content, availability, conditions, selection and any tenancy.

Dean does not guarantee a particular coverage, frequency, timeliness, completeness, provider response time, viewing, successful application or home. You remain responsible for checking a listing, its source and the external provider's conditions.

Dean may technically retrieve, normalise and compare public or externally published listing data. Public accessibility is not general consent, a licence or a waiver of rights by a source, provider or rightsholder. Dean does not state that every source permits scraping or every form of reuse.

Copyright, database rights, trade mark rights and other rights in source websites, listings, images and data remain with the relevant rightsholders. Processing does not give Dean ownership or an unrestricted right to use that material. We recognise, among other things, the limits in Article 2 of the Dutch Database Act. Dean may limit, block or remove a source, listing, image, data element or technical access because of law, a substantiated rightsholder or removal request, source terms, technical restrictions, risks to normal exploitation or its own balancing of interests. This may happen without prior notice where immediate limitation is reasonably necessary.

Rightsholders and representatives may send a reasoned request to help@heydean.nl with the relevant URL, legal basis and evidence of authority. Dean assesses such requests carefully; a temporary restriction is not an admission of liability or infringement.

For the term of the agreement, Dean grants you a personal, revocable, non-exclusive and non-transferable right to use the Service for your own use. This does not include a right to commercially exploit, resell, publish, collect in bulk or use as a database source content, Dean data, alerts or access.

You provide accurate account and payment details, keep login details confidential and promptly report suspected misuse to help@heydean.nl. You are responsible for activity through your account unless you could not reasonably have prevented the loss or misuse of your credentials.

You may not bypass security, disrupt the Service or external sources, retrieve data from Dean automatically in bulk, reverse engineer the software except where mandatory law allows it, send misleading or unlawful messages, cause spam, or use the Service contrary to law, third-party rights or these terms.

Current plans, features, limitations, price, any VAT and billing frequency are shown on the website and in Stripe Checkout. Unless stated otherwise there, subscriptions are invoiced monthly in advance and automatically renew after each subscription period until cancelled in time.

Stripe provides the hosted payment flow, invoicing and customer portal. By confirming a subscription, you authorise Stripe and the payment method you select to collect the recurring amounts due, where that method supports recurring payments. Stripe and the selected payment method also have their own terms and privacy rules.

You keep payment details current and ensure sufficient funds. If a payment fails, is reversed or charged back, Dean may retry collection, suspend access to paid features after reasonable notice and request payment of outstanding amounts. Costs will be charged only where they were clearly disclosed in advance or are due under mandatory law.

A change to price, plan or billing frequency for an ongoing subscription will be communicated in advance in an appropriate way. If the change materially disadvantages you, the termination rights provided by mandatory law apply.

Where Dean Radar expressly offers a Radar trial at sign-up, that trial lasts three days. It starts only after you confirm Radar in Stripe Checkout. The exact start and end time are shown in Stripe Checkout and, once you have access, in the Stripe customer portal.

Stripe may request a payment method for the trial. Unless Stripe states otherwise in the payment flow, no subscription amount is collected during the trial. After the stated end time, Radar automatically becomes a paid monthly subscription of €9.95 unless you cancel before that time.

A trial is available no more than once per person or account and is not intended to be reused through new accounts. If you cancel during the trial, the renewal ends; access remains, where technically available, until the stated end of the trial. Signaal and Atlas have no trial and start as paid subscriptions.

You can cancel a monthly subscription at any time through the Stripe customer portal in your dashboard or by sending a clear cancellation to help@heydean.nl. A clear cancellation by email is effective when Dean receives it; a confirmation from Dean is administrative only. Keep a copy of your cancellation.

After an ordinary cancellation, paid access generally remains available until the end of the already paid subscription period. No further period amounts are then collected. Deleting an account is not the same as cancelling a subscription; complete both actions if you wish to end both access and the subscription.

As a consumer, you generally have a statutory fourteen-day cooling-off period for a distance contract. If you request immediate supply during that period, the statutory consequences of that choice, including any proportionate charge for services already supplied, may apply. In addition to, and without limiting, statutory rights, Dean offers a 14-day money-back guarantee. A request is valid if the consumer sends a clear request to help@heydean.nl within fourteen days after the first successful payment of the first monthly subscription, from or with enough information about the account used, and there is no fraud, misuse, repeated use through new accounts or chargeback abuse.

For a valid request, we refund the first paid monthly amount, cancel the subscription and complete the refund and cancellation within fourteen days. The guarantee never limits statutory withdrawal rights, statutory conformity rights or any other mandatory consumer rights. A statutory right that is more favourable remains fully available.

For consumers, where applicable, the mandatory rules on digital content and digital services in Book 7, Title 1aa of the Dutch Civil Code apply. Dean supplies the Service in accordance with the agreement and statutory conformity requirements. If there is a lack of conformity, you have the statutory remedies that apply in the circumstances, such as repair, price reduction or termination. Report a complaint promptly and as clearly as possible to help@heydean.nl, including your account email address, a description of the problem and relevant screenshots or information. We acknowledge receipt where reasonably possible and handle the complaint within a reasonable period.

Dean makes reasonable efforts to provide the Service with due care, but may perform maintenance, change features or sources, or temporarily limit the Service when necessary for security, law, technical continuity, suppliers, source availability or improvement. We take reasonable measures to limit disruption where possible.

For a change to a digital service that materially and adversely affects a consumer, we follow the applicable statutory information and termination rules. Non-material changes necessary for security, repair, compliance or technical operation may be made without separate consent.

Dean may temporarily suspend access or terminate the agreement for a serious or repeated breach of these terms, fraud, a security risk, payment default or legal necessity. Where appropriate, we give a prior warning and opportunity to remedy. This does not affect your mandatory rights.

Dean is not liable for decisions, data, availability, conditions, selection or conduct of external providers, or for missed opportunities arising from an external listing, source change, network failure or a circumstance outside Dean's reasonable control. This does not remove Dean's obligation to comply with its own statutory duties for the Service.

To the extent permitted by law, Dean's liability is limited to direct loss and to the higher of €100 or the subscription fees you paid in the three months before the event causing the loss. Dean is not liable for indirect loss, consequential loss, lost income, lost savings or loss of data to the extent that exclusion is legally permitted.

Nothing in these terms limits liability that cannot lawfully be excluded or limited, including liability for Dean's own intentional misconduct or deliberate recklessness, liability for death or personal injury where applicable, and mandatory consumer rights.

Dean may change these terms for future orders and, for an ongoing agreement, where there is a valid reason, such as a change in law, the Service, cost structure, security or suppliers. For a material change to an ongoing consumer agreement, we notify you in advance on a durable medium or otherwise in an appropriate way, subject to mandatory law.

Dutch law governs the agreement. If you are a consumer living in another EU Member State, you remain protected by mandatory provisions of the law of your country of residence to the extent that protection cannot be excluded by contract.
